Terms and Conditions
Effective Date: July 2025

These Terms and Conditions (“Agreement”) apply to all services provided by Transparent Property Services LLC (“Company,” “we,” “us,” or “our”) to the customer (“Client,” “you,” or “your”). By signing or approving the estimate provided, you acknowledge and agree to the terms outlined below. These terms are binding upon acceptance of the estimate and are applicable to both residential and commercial services.

1. Scope of Work

The services to be performed are limited to those explicitly stated in the approved estimate or work order. These may include, but are not limited to: pressure washing, soft washing, gutter cleaning, roof cleaning, window washing (interior and exterior), dryer vent cleaning, deck and fence cleaning, trash bin cleaning, stain and graffiti removal, paver sealing, upholstery cleaning, carpet cleaning, and minor interior services. Any additional work requested outside the agreed-upon scope must be approved in writing and may be subject to additional charges. We reserve the right to refuse services that exceed the safe or legal limitations of our staff, equipment, or licensing.

2. Estimate Acceptance

Estimates are valid for thirty (30) calendar days from the date of issuance. A signed or electronically accepted estimate constitutes acceptance of the terms within this Agreement and creates a legally binding contract between the Client and the Company.

3. Scheduling & Site Access

We will coordinate with the Client to schedule services following estimate approval. Scheduling may be impacted by weather, site conditions, safety issues, or equipment needs. The Client agrees to provide unrestricted and safe access to the property, including access to:

  • All work areas, including gated or locked spaces

  • Operational exterior water spigots

  • Electrical outlets, where required (see Section 8)

  • Driveways and parking areas for equipment access

Any delays caused by lack of access may result in rescheduling and/or additional fees.

4. Client Responsibilities

To ensure the safety and efficiency of our services, Clients are responsible for the following prior to service:

  • Secure all windows and doors and ensure they are fully closed and locked

  • Notify us in advance of any leaks, damaged seals, or water intrusion issues around windows, doors, or vents

  • Disclose any known vulnerabilities, such as loose siding, weak trim, or deteriorating materials

  • Remove or relocate outdoor furniture, decorations, potted plants, toys, grills, and vehicles from the service area

  • Pick up pet waste in service zones before scheduled service

  • Keep pets and children safely indoors or away from the work area during service

  • For interior services, such as carpet or upholstery cleaning, move fragile or valuable items out of the service area

The Company is not liable for damage caused by failure to complete these steps.

5. Payment Terms

Payment is due in full upon completion of services unless otherwise agreed in writing. We accept cash, checks, and major credit/debit cards. Late payments may be subject to a late fee of $25 or 5% of the invoice total, whichever is greater. Returned checks will incur a $35 fee.

6. Cancellations & Rescheduling

Cancellations must be made at least 24 hours in advance. Cancellations with less than 24 hours' notice may be subject to a $50 cancellation fee. Weather-related postponements will be rescheduled promptly at no additional cost. If we arrive at a scheduled service and are unable to perform work due to access issues, unprepared sites, or safety concerns, a trip charge may apply.

7. Service-Specific Notes

  • Pressure & Soft Washing: We cannot guarantee the removal of all stains. Some surfaces may lighten or react due to age, material type, or preexisting damage.

  • Roof Cleaning: Roofs are cleaned using soft washing only. Clients acknowledge that preexisting moss, algae, or lichen may take several weather cycles to fully release.

  • Gutter Cleaning: Includes debris removal and flow test. We do not service or inspect underground drain systems.

  • Window Cleaning: We are not responsible for etching, scratches, or defects in glass caused by previous services or poor-quality glass.

  • Interior Cleaning (e.g., carpet/upholstery): Areas must be clear and safe to access. Furniture may be moved at our discretion. We are not responsible for damage to unsecured or delicate items.

8. Electrical & Installed Equipment Disclaimer

The Client agrees that all exterior electrical outlets, fixtures, and equipment (including lighting, junction boxes, cameras, speakers, etc.) have been properly installed, rated for outdoor use, and are in good working condition as per manufacturer guidelines. Transparent Property Services LLC is not liable for damage to any exterior electrical components that are improperly sealed, deteriorated, or not rated for water exposure.

9. Limitations of Liability

We take every reasonable precaution to protect your property, but we are not liable for:

  • Preexisting conditions or damage

  • Poorly installed or deteriorating materials or fixtures

  • Damage due to undisclosed leaks or vulnerabilities

  • Incidental or consequential damages beyond the value of the service

All claims must be submitted in writing within 72 hours of service completion. Our total liability shall not exceed the amount paid for the disputed service.

10. Limited Warranty

We guarantee that services will be performed professionally and with care. However, we do not guarantee that surfaces will remain clean or stain-free following service, nor do we warranty against future mold, mildew, or algae growth. Additional warranties must be explicitly stated in writing.

11. Right to Refuse Service

The Company reserves the right to refuse or cancel service for any reason, including but not limited to:

  • Unsafe working conditions

  • Threatening or inappropriate behavior

  • Misrepresentation of service needs

  • Inaccessible or unprepared sites

If service has begun, the Client may be charged for time and materials used up to the point of termination.

12. Photographs & Marketing Use

We may take before-and-after photos for internal documentation and promotional use. No personally identifying information will be shared. Clients may opt out in writing before service if they do not wish their property to appear in marketing materials.

13. Governing Law

This Agreement is governed by the laws of the State of New York. Any disputes arising from this Agreement shall be resolved in the courts of Erie County, NY.

14. Entire Agreement

These Terms and the accepted estimate represent the entire agreement between the Company and Client. No oral or implied changes are valid unless confirmed in writing and signed by both parties.
